The
Bankruptcy and Insolvency practice has experience
and expertise in a wide variety of bankruptcy and
debtor-creditor related matters. The group's practice
includes debtor, creditor and fiduciary representations
in bankruptcy proceedings, pre-bankruptcy “workout”
and insolvency counseling, and related state court
litigation involving receiverships, attachments, real
and personal property foreclosure actions.
CREDITOR
REPRESENTATION
The Bankruptcy and Insolvency Group attends
to a substantial representation of a variety of creditor
interests in both judicial and non-judicial proceedings.
Representative clients include trustees and secured
and unsecured creditors. Individual clients include,
for the most part, major banks, federal credit unions
and other institutional lenders, in addition to equipment
lessors and landlords.
Our
creditor representation includes efforts to restructure
debt through informal workout negotiations as well
as legal proceedings to foreclose security interests
or mortgages and for recovery of personal property.
In bankruptcy court proceedings, our services on behalf
of individual creditors have specifically included
actions to recover funds or property on behalf of
such creditors as well as other actions.
LITIGATION
The Firm handles all aspects of bankruptcy
litigation, including fraudulent transfer claims,
preference actions, claims litigation, and directors
and officers' litigation, and securities litigation.
We also represent clients in conducting arbitrations,
mediations and alternative dispute resolution proceedings,
providing them with a cost effective alternative to
litigation.
